By creating an account or placing an order, you confirm that you have read and accept them. 1. Definitions Service: the OwnEbook online platform, available at https://ownebook.com. Customer: any person who creates an account on the Service. AI balance: prepaid credit used to pay for artificial intelligence operations individually. Subscription: a plan that renews automatically at the interval chosen by the Customer. 2. Account Creating an account requires accurate, up-to-date information. The Customer is responsible for keeping their credentials confidential and for all activity carried out from their account, and must inform OwnEbook without delay of any unauthorised use. The Service is reserved for people with the legal capacity to contract; a minor may use it only through their legal representative. 3. Description of the service From the Customer's instructions, the Service produces draft text and images intended for preparing a book. Features may change, be added to or be withdrawn in order to improve the Service or to comply with a legal obligation. 4. Acceptable use You must not, in particular: produce or distribute unlawful, defamatory, hateful, violent or pornographic content, or content involving minors; infringe the intellectual property, privacy or image rights of a third party; impersonate a person or an organisation, or present generated content as coming from a third party; circumvent the technical limits, quotas, security measures or billing controls of the Service; resell access to the Service, share it between several users, or automate it at scale without written permission. 5. Customer content and generated results The Customer keeps ownership of the texts, images and files they provide. To the extent permitted by applicable law and by the conditions of the technical providers, results produced from their instructions are intended for them and may be used, including commercially. The Customer warrants that they hold the rights necessary for the content they upload, and remains responsible for reviewing, correcting and publishing the results. 6. Limitations of artificial intelligence Results are generated automatically. They may contain errors, approximations, inaccurate statements or passages resembling existing works. They are not legal, medical, financial or tax advice. Human review is required before publishing anything, or making any decision based on them. OwnEbook does not warrant the accuracy, originality or fitness for a particular purpose of the results. 7. AI balance and subscriptions The Service offers two ways to pay: AI balance: the Customer adds funds in advance. Each completed operation is charged individually and the exact amount appears in the Customer's transaction history. The balance does not expire while the account is open. Subscription: the Customer subscribes to a plan that renews automatically at each due date until cancelled, at the interval and price shown at the time of subscribing. Applicable prices are displayed before an order is confirmed. By subscribing, the Customer expressly authorises the corresponding recurring charges, at the interval and for the amount shown, until the subscription is cancelled. 8. Payment Payments are handled by external payment providers. OwnEbook does not collect or store card numbers. An order is carried out only once the provider has confirmed payment. Where a payment fails or is not made, the Service may be suspended until the situation is resolved. 9. Immediate performance In accordance with Law no. 31-08 laying down consumer protection measures, a Customer who asks for a digital service to be performed immediately, and receives it, can no longer withdraw in respect of the part already performed. Cancellation and refund arrangements are set out in the refund and cancellation policy, which forms part of these terms. 10. Suspension and termination OwnEbook may suspend or close an account in the event of a breach of these terms, non-payment, fraudulent use, a risk to the security of the Service, or a legal obligation. Except in an emergency or where the law requires otherwise, the Customer is informed and given the opportunity to remedy the breach. The Customer may close their account at any time; closing it does not give a right to a refund of services already performed. 11. Availability and liability The Service is provided "as is". OwnEbook uses reasonable means to keep it available and secure, without warranting uninterrupted, error-free operation, in particular during maintenance or where a provider fails. To the extent permitted by law, the liability of OwnEbook under the Service is limited to the amounts actually paid by the Customer during the twelve months preceding the event giving rise to liability, and does not cover indirect loss such as loss of revenue, customers, reputation or data. These limitations do not apply in the event of fraud or gross negligence, nor where the law prohibits them. 12. Force majeure Neither party is liable for a failure caused by an event of force majeure within the meaning of Moroccan law, for as long as that event lasts. 13. Changes to these terms These terms may be amended. A new version is then published on the Service with its effective date, and the Customer is informed by reasonable means. The version applicable to an order is the one the Customer accepted when placing that order. 14. Governing law and disputes These terms are governed by Moroccan law. In the event of a dispute, the Customer should first write to support@ownebook.com; a reply will be provided within a reasonable time. Failing an amicable solution, the dispute falls to the competent Moroccan courts, without prejudice to the mandatory rules of jurisdiction applicable to consumers. 15. Scope of this document This document is a general template provided for information only. It is not legal advice. The operator of the Service should have it reviewed and adapted by a qualified lawyer before relying on it.
